Section 3 is where the Central Government gets the power to take measures it deems necessary to protect the environment, like setting standards. Section 5 gives officers like me the authority to enter, inspect, and take samples from any place. The penalties, under Section 15, can mean jail time up to five years or heavy fines—but in my decade of service, I’ve seen that a genuine, respectful conversation at the first visit does more to change a unit’s practices than any fear of punishment ever does.
